This agreement shall be governed by and construed in accordance with the laws of England and Wales and you hereby agree to submit to the exclusive jurisdiction of the English courts.

Motofy aim to ensure that all our details on the website are correct, especially our contact details. However, if third parties supply any information, we cannot guarantee its accuracy.

Any information you find on our website that you find to be incorrect or related to any law matters should result in a notification to us, and we will try to correct it.

  • Customers are required to note that we will contact them via email, sms or phone all if the part they require is in stock.
  • Please be aware that all members of our supplier network are independent and do not work for us. Make notes of details such as telephone numbers etc. Do, however, contact us to check if a member is part of our network, as a precaution.
  • If you purchase a part, it will comply with The Sale of Goods Act 1994. It will be of ‘satisfactory quality’. If there are any quality aspects we need to tell you about, we will tell you at the point of sale.
  • Every part you purchase will always have a minimum guarantee of at least 7 days.
  • The guarantee only covers the parts on your invoice.
  • Each part will have a dismantlers stamp on it, if this is removed your guarantee will be void.
  • No parts can be tampered with/modified or otherwise changed without express permission from the supplier. If such a thing occurs the guarantee will be void.
  • In the unlikely event that a part is faulty or incorrect the supplying member has to be notified within a 48-hour period.
  • Refunds are only possible once goods have been returned to the supplier.
  • Glass is supplied and delivered at the customer’s own risk, due to insurance issues. Any breakages are at own risk, and there are no refunds.
  • Check your goods before signing for them. This is because refunds are not always possible for goods damaged while in transit. If the goods are signed for as being in good condition no refund will be applicable from supplier side.
  • All parts are supplied as parts only, not labor. Any labor charges incurred to fit your part are your responsibility.
  • We cannot accept liability or responsibility for the quality of any part supplied, or any damage or loss that results from its use.

         
How we communicate with you

  • We ensure that we use a wide variety of communication systems to help you get the very best results for your parts service.
  • For emails, the first one you receive will be the one that confirms you have made a parts request. This will include all the appropriate details about your requested part/parts, including part number and any other information that will help you get the most out of our service.
  • If we found your part/parts on our supplier’s network, suppliers will send you quote via emails and in some instant they call directly to customers. The email that confirms any parts from suppliers will only contain your part request and supplier quote and contact details.
  • Other details will include the cost of the part and the delivery details. You will also be notified of the condition of the part.
  • If we contact you by text we will ensure that we will send you telephone number  so you can purchase your part/parts directly without any delay. If you need to find out further information other than what is contained in the text we encourage you to login to our website. We also help our customers to find their requested part(s) from independent suppliers around the country those are specialize for different vehicle manufacturer parts. For that service our customers have to use a premium phone line to directly get in touch with them. This service could cost 50ppm. Calls to any 070 number placing on our website are charged at 50ppm (Network extras may apply).
  • Our login area is to be used for finding out information about quotes and tracking quotes. You will need to use your email address and your password, which will be given to you when you start using the service for 1st time.
  • Please note that you can only retrieve quotes from this site once you have actually received quotes from an email or SMS source.
  • All the emails and SMS quotes will include a telephone number where you have to contact to make your purchase.
  • If you do not feel comfortable at any point with contacting the supplier, and are unhappy with the contact so far, you can remove your part requests from your account and if you completely want to switch off our service please email us at, accounts@motofy.co.uk.

Customers are reminded that access to our website is for lawful purposes only, and there is a strict condition that users are aged 18 years or over.
Users must not break any laws or any aspects of legislation while using our site.
Users must be mindful of the site security, and if they try to breach it, will be pursued for damages and/or other recompense under the law.

As part of your own security, you must ensure your passwords and/or logins are kept secure.

You must not download or print anything from the website without our explicit permission, and you may not link to this site without our permission.

We provide 2 Years warranties on all of our items. Some parts are directly coming from suppliers and all the details about parts and warranties are mentioned in details

We are unable to promote or endorse, or warrant any product of any manufacturer that is supplied to you by third party (supplier).

We cannot guarantee that you will receive a quote or part, since they are all provided by a subscriber network, and not by us. Supply is also dependent on stock.


The best way to pay

If you use Motofy.co.uk and pay through credit/debit card then you are fully protected from your bank or finical authority. If you pay another way we’ll still try to help, but we recommend everyone uses credit/debit card for payment. All the prices start from on our website are based the lowest quote prices from suppliers. We have no control on suppliers or quote prices.

If something goes wrong

The first thing to do is to contact our customer support team and try to sort out the issue. If you still disagree let us know and we’ll investigate with supplier, keeping you in touch every step of the way.

LIABILITY LIMITATION

We accept no liability for any loss or damage on your goods or property, because we have no contractual agreement for such parts or the sale of parts.

We do not intend to limit any rights or freedoms as a consumer, under any applicable law or other rights you may have. We also do not seek to limit or exclude liability for your death or personal injury for any service we provide.

We do not review quotes, and do not check for accuracy, because they originate form a network of suppliers. We do not accept liability for any loss or damage arising from any contract you make with the supplier.

It is your responsibility as a consumer to seek advice on any contract you enter into with a supplier. Any losses suffered as a result of such a contract are not our responsibility.

If you do not act on any quotation within 30 days of the quote we exclude any liability for any loss that may occur.

If a notice is sent to you, we shall deem it received at an address provided by you.

Any failure to bring about a remedy or to exercise any right does not constitute a waiver of any rights or remedies. This shall not affect any later right to exercise these rights.

We shall not call you at any stage regarding inquiries about a quote to a spare part, because we do not sell products. We may liaise with you so that we may clarify some points of information you have supplied on the site, and/or to discuss a complaint. W shall clarify our identity before we do so.

We may change these terms and conditions at any time and at our discretion. We shall inform customers of this trough our site.


CONTRACT RIGHTS OF THIRD PARTIES

Any person who is not party to these terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms set out herein. This clause does not affect any right or remedy of any person that exists or is available otherwise than pursuant to that Act.

ENTIRE AGREEMENT
These Terms and Conditions (together with any policy referred to herein), constitute the entire agreement between us in relation to use of this website and any services we offer through it and supersede all previous agreements between us.
